Nevada Guardian Services Releases Free Attorney Resource Kit on Nevada Guardianship

The kit contains six documents: an agency overview, a set of frequently asked questions written for attorneys, a summary of National Guardianship Association Standards 5, 9, and 10, an overview of the Protected Person’s Bill of Rights, a quick reference guide for guardianship referrals, and a collection of case studies in professional guardianship.

The referral guide addresses the question attorneys most often face at intake: whether a situation calls for full guardianship or whether a less restrictive arrangement will protect the client adequately. Nevada courts require that guardianship be considered only after less restrictive alternatives have been examined, and options such as a Power of Attorney, a representative payee, or supported decision-making may allow a person to retain more independence.

The document summarizes those retained rights in plain language for use in client conversations.

The National Guardianship Association standards summary covers three areas central to how a professional guardian should operate: standards governing the guardian’s relationship with the protected person, decision-making practices, and the guardian’s duty to seek the least restrictive alternative. Nevada Guardian Services operates as a nationally certified guardian agency and follows those standards in each case it accepts.

Nevada guardianship is court-supervised under NRS Chapter 159. Guardians file care plans, status reports, and financial accountings for court review, and professional guardians are compensated only after a court approves a fee petition documenting time spent and benefit to the protected person.
